1. About these terms

These Terms of Use (“Terms”) apply to your use of automationone.ca (the “site”), which is operated by Automation One Business Systems Inc. (“Automation One,” “we,” “us”). By using the site, you agree to these Terms. If you do not agree, please do not use the site. If you use the site for a business or other organization, you confirm that you are authorized to accept these Terms on its behalf.

2. Using the site

You are welcome to use the site to learn about our products and services, contact us, request a quote, request service or supplies, and download the documents and links we make available. When you use the site, please do not:

  • use it in a way that breaks any law or anyone else’s rights;
  • try to gain unauthorized access to the site, its servers, or any connected system or account;
  • interfere with how the site works, including by introducing malware or overloading it;
  • copy or harvest content or contact details in bulk with automated tools, other than normal search-engine indexing; or
  • submit false or misleading information, or information about someone else without their permission.

We may change, suspend, or restrict access to all or part of the site at any time, for example for maintenance or if we believe the site is being misused.

3. Product information and availability

We work to keep the site accurate and current, but product descriptions, specifications, features, images, brochures, and availability are provided for general information only. Much of this information comes from manufacturers and may change without notice. Images may be illustrative and may show optional accessories. Mistakes can happen, so please confirm any detail that matters to your decision with our team.

Nothing on the site is an offer to sell or lease, a price commitment, or a promise that a particular product, configuration, or service is available.

4. Quotes, sales, and service agreements

The site does not create a contract for the sale, lease, rental, or service of any equipment, software, or supplies. Pricing, equipment, supplies, service coverage, warranties, and all other terms are set out in a written quote, proposal, or agreement from Automation One, in any lease or financing agreement, and in any manufacturer warranty that applies, together with any warranties or conditions the law provides that cannot be excluded (for example, for consumer purchases under BC’s Sale of Goods Act and Business Practices and Consumer Protection Act).

Descriptions of our service and support on the site are general summaries. If anything on the site differs from a written quote or agreement you have with us, the written quote or agreement governs.

5. Request a Quote and other forms

The site includes forms such as Request a Quote, contact, service request, toner and supplies, network survey, and billable request forms. At present, submitting one of these forms opens your own email app with a draft message addressed to our team; nothing is sent until you send it from your email account.

Sending a request, whether through a form, by email, or by phone, does not create an order, a contract, or a commitment by either of us. A quote, order, or service call is confirmed only when we confirm it with you. Please give accurate information, and do not include payment card numbers, passwords, or other sensitive information in a form or email. Our Privacy notice explains how we handle the information you send us.

6. Remote Support

The Remote Support link on the site lets you download a remote-access app (a custom AnyDesk client from AnyDesk Software GmbH) so that an Automation One technician can connect to your computer to help with a support issue. A session starts only when you run the app and give the ID and code it shows to our technician.

  • Use Remote Support only when you have asked us for help, or have agreed to a session with a technician you know is from Automation One. You can end a session at any time.
  • Only start a session on a computer you are authorized to allow access to, for example under your organization’s IT policies.
  • Before a session, save your work and close anything you do not want the technician to see. Keeping current backups is always a good idea.
  • If you get an unexpected call, email, or message asking you to install remote-access software in our name, please call us at 604-255-6622 (toll-free 1-888-630-5880) to confirm before you do anything.

During a session, our technician will view or access only what is needed to fix the issue you asked about, and will ask you before opening, copying, or changing any of your files. Remote Support sessions are recorded. We handle recordings, and any personal information we can see or access during a session, as described in our Privacy notice.

The remote-access app is provided by AnyDesk, not by us, and is subject to AnyDesk’s own terms. We take reasonable care during support sessions, but to the extent permitted by law we are not responsible for problems caused by the third-party app or by existing conditions on your computer.

7. Brands and trademarks

Canon, Xerox, Lexmark, Francotyp-Postalia (FP), Ideal.MBM, and other product names, brand names, and logos shown on the site are trademarks or registered trademarks of their respective owners. Automation One is an authorized dealer of Canon, Xerox, Lexmark, FP, and Ideal.MBM and uses their names and logos with their permission. Showing these names and logos does not mean that any manufacturer sponsors or endorses the site, and it does not give you any right to use them.

The Automation One name and logo belong to Automation One Business Systems Inc. and may not be used without our written permission.

8. Our content

The site and its content, including text, graphics, photos, videos, logos, page design, and downloadable documents, are owned by Automation One or used with permission from their owners, including manufacturers, and are protected by copyright and other laws. You may view the site, and download or print pages and documents for your own internal business use (such as evaluating products or sharing information within your organization), as long as you keep any copyright and other notices. You may not otherwise copy, republish, modify, sell, or distribute site content without our written permission, except as the law allows (for example, fair dealing under the Copyright Act).

Drivers, software, and manuals from manufacturers, whether downloaded through the site or from a manufacturer’s own site, are subject to that manufacturer’s licence terms.

The site links to websites and services we do not control, such as manufacturer support and driver pages, social media, award sites, and the provider of our remote-support app. We provide these links for convenience only. We are not responsible for the content, availability, security, or privacy practices of other sites, and a link does not mean we endorse them. Your use of another site is subject to that site’s own terms and policies.

10. Our online store

Our online store at automationone.ca/store is coming soon. When it launches, store purchases will be governed by the store’s own terms, which will be shown at checkout. These Terms do not cover store purchases. Until then, please contact us to order equipment, toner, or supplies.

11. Disclaimer

The site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Automation One makes no representations, warranties, or conditions of any kind about the site or its content, whether express or implied, including any implied warranties or conditions of merchantable quality, fitness for a particular purpose, accuracy, or non-infringement. We do not promise that the site will be uninterrupted, error-free, or secure, or that it or any download will be free of viruses or other harmful components.

This disclaimer is about the website. Warranties for the equipment, supplies, and services we provide are set out in your written quote or agreement with us and in any applicable manufacturer warranty, together with any warranties or conditions the law provides that cannot be excluded (for example, for consumer purchases under BC’s Sale of Goods Act and Business Practices and Consumer Protection Act).

12. Limitation of liability

To the fullest extent permitted by law, Automation One and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of, or inability to use, the site or its content, even if we were told that such damages were possible.

Nothing in these Terms limits or excludes any liability or any right you have that cannot be limited or excluded under applicable law. This section applies to the website; liability for the equipment, supplies, and services we provide is governed by your written agreement with us.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Automation One and its directors, officers, employees, and agents from any claims, losses, damages, and costs (including reasonable legal fees) that arise from your misuse of the site or your breach of these Terms.

14. Privacy

Our Privacy notice explains how we collect, use, and protect personal information when you use the site or contact us. It forms part of how we operate the site, so please read it together with these Terms.

15. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. You and Automation One agree that any dispute about these Terms or the site will be brought in the courts or tribunals of British Columbia (including the Civil Resolution Tribunal for small claims), except where applicable law gives you the right to bring it elsewhere.

16. General

If any part of these Terms is found to be unenforceable, the rest of the Terms stay in effect. If we do not enforce a part of these Terms right away, we can still enforce it later. These Terms, together with our Privacy notice, are the entire agreement between you and us about your use of the site. They do not replace any written quote or agreement for products or services.

17. Changes to these terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and change the “Last updated” date. Changes take effect when they are posted. If you keep using the site after a change, you accept the updated Terms.
